Below are the City of Scottsdale home-based business zoning rules and an excerpt from the Scottsdale Ranch CC&Rs. Check your homeowner’s association CC&R for the exact rules that apply to your residence.

Common problems with home businesses:

1. Employees: The City of Scottsdale prohibits outside employees from working at your residence.
2. Customers and Vendors: The City of Scottsdale allows customers to visit their business at home as long as “excessive foot or vehicle traffic” is not generated. The sample CC&Rs prohibit all home-based business-related traffic.
3. Signage – Prohibited by the City of Scottsdale.

City of Scottsdale Home Business Zoning Rules

1. Occupancy of the dwelling must be a secondary use of the dwelling unit and not alter the exterior of the building and not affect the residential character of the neighborhood.
2. No one other than the family residing in the housing unit may be employed in the occupation of the dwelling.
3. No exterior displays, exterior storage, signs, or any other exterior indication of home occupancy are permitted.
4. No part of the carport or garage or accessory building may be used for residential occupancy.
5. No merchandise will be sold or traded on the premises.
6. No mechanical equipment except that normally used for household, hobby, standard office, or household purposes is permitted.
7. The occupation of the house will not generate excessive pedestrian or vehicular traffic.
8. All other City of Scottsdale codes and ordinances must be followed.

Scottsdale Ranch Homeowners Association CC&R Examples (from May 6, 2004 CC&R pages 36-37)

(a general. Property classified as “Single Family Residential” under a Declaration of Tract may be used only for the construction and occupancy of separate single-family dwellings and typical residential activities associated therewith, such as construction and use of a family swimming pool. All properties within such Land Use Classification shall be used, improved, and dedicated solely to single-family residential use No occupation, profession, trade, or other non-residential use, including, but not limited to, any occupation, work, or activity undertaken on an ongoing basis that involves the provision of goods or services to persons other than the supplier’s family, regardless of whether: (i) the activity is performed full-time or part-time; or (ii) the activity is intended to generate or generates a profit, may be conducted on or from a Lot, Parcel, or dwelling, except that the owner or occupant residing within Scottsdale Ranch may conduct such ancillary business activity within the residence provided that:

(i) the existence or operation of the business is not apparent or detectable to sight, sound, or smell from outside the residence;

(ii) the business activity does not involve persons entering the community who do not reside in the community for the purpose of receiving products or services arising from such use or door-to-door solicitation of residences in the community;

(iii) the commercial activity meets all zoning requirements for the community; and the business activity does not constitute a nuisance, danger, offensive use, or threat to the safety of residents.
